Commercial Leases

Whether you are the landlord or the tenant, leasing commercial space is complex and important. Commercial lease agreements should be negotiated with care and drafted with precision. Despite what you may have heard, there is no "standard" commercial lease. Landlords will often have a form they use, which may or may not have been drafted with careful attention to the needs of the particular property with its particular tenants.

Under Maine law, a commercial lease can say pretty much anything, and what it says will be enforced. Working with a lawyer before signing is almost always worth it.

Residential Leases

Residential leases (for apartments, homes, etc.) are subject to more legal regulation than commercial leases, but under Maine law it is still the general rule that what the lease says, goes. If you are a residential landlord, it pays (literally) to have a carefully-drafted standard lease form. And if you are a residential tenant (as most people are or have been at some point), it is important to know what you are getting into and what it means.
